These terms and conditions (“Terms”) govern the purchase and use of digital gift cards (“Gift Cards”) issued by Smell.fit (“We,” “Us,” or “Our”). By purchasing, accepting, or using a Gift Card, you agree to be bound by these Terms.
1. Purchasing and Delivery
Format & Delivery: All Smell.fit Gift Cards are issued in digital format only (e-Gift Cards) and are delivered instantly via email directly to the recipient’s email address provided at the time of purchase. No physical card will be shipped.
Recipient Information: It is the purchaser’s responsibility to ensure the recipient’s email address is correct. We are not responsible for any Gift Cards lost, stolen, or used by unauthorized individuals due to an incorrect email address.
2. Redemption and Usage
Redemption: Gift Cards can only be redeemed online at our website: www.smell.fit.
Accepted Currency: Gift Cards are denominated in GBP and can only be used for purchases on the website in that currency.
Applicability: Gift Cards may be used to purchase any goods currently available for sale on the Smell.fit website, excluding the purchase of other Gift Cards.
Multiple Use: The Gift Card balance can be spread across any number of different transactions until the value is fully depleted or the card expires.
Partial Redemption: If the purchase total is less than the Gift Card balance, the unused balance will remain on the Gift Card and can be applied to future purchases.
Exceeding Value: If a purchase exceeds the Gift Card balance, the remaining amount must be paid using another accepted payment method (e.g., credit card, PayPal).
Top-Up Restriction: Gift Cards cannot be topped up, reloaded, or have additional value added after the initial purchase.
Non-Transferable: Gift Cards are non-transferable and are intended for use by the original recipient.
3. Validity and Expiration
Expiration Date: Gift Cards are valid for 365 days (one calendar year) from the date of purchase. Any remaining balance on the Gift Card will expire and be forfeited after this 365-day period.
Fees: No service fees or dormancy fees will be charged against the Gift Card balance.
4. Balance Inquiries
Checking Balance: The remaining balance on a Gift Card can be checked by visiting our Gift Card balance checker.
5. Returns and Refunds
Non-Refundable: Gift Cards are strictly non-refundable once purchased and cannot be exchanged for cash, except where required by law. Notably, the UK distance selling regulation covering online sales and the 14 day cooling-off period as laid out in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. (*Please note that if the Gift Card is used towards a purchase in the first 14 days after purchase, the 14 day cooling-off period is voided.)
Goods Purchased: Products purchased entirely or partially with a Gift Card are subject to our standard Return and Refund Policy. If a product purchased with a Gift Card is returned, the portion of the purchase made with the Gift Card will be credited back to the original Gift Card code.
6. Lost, Stolen, or Unauthorised Use
Responsibility: The recipient is responsible for safeguarding their Gift Card code. Treat the Gift Card like cash.
Loss/Theft: We are not responsible for lost, stolen, destroyed, or unauthorized use of Gift Cards. We cannot replace Gift Card codes unless the original code and proof of purchase can be verified and the code has not yet been used.
7. Amendments
We reserve the right to change these Terms and Conditions at any time. The terms posted on the Smell.fit website at the time of purchase or redemption will govern that transaction.
Gift Card FAQs
1. How is the Digital Gift Card delivered?
The Gift Card is delivered instantly via email directly to the recipient’s inbox. The purchaser simply provides the recipient’s email address and an optional personal message during checkout.
2. When does the Gift Card expire?
The Smell.fit Gift Card is valid for 365 days (one full year) from the date of purchase. Please ensure the recipient uses the full balance before the expiration date, as any remaining value will be forfeited afterward.
3. Can the balance be spread across multiple orders?
Yes! The Gift Card balance can be used across as many different orders as you like until the full value has been spent or the card expires. If your order exceeds the card’s value, you can pay the difference with another method.
4. Can I add more money to the Gift Card?
No. Gift Cards cannot be reloaded or topped up after the initial purchase. Please purchase a new Gift Card
5. Can I get a refund for a Gift Card?
In the UK, customers are legally entitled to a 14 day cooling-off period on all online purchases, including digital purchased. If a customer wishes to cancel a gift card, they must contact Smell.Fit Fragrances within 14 days. If the Gift Card has already been used against a purchase, this right to return is void. Gift Cards cannot be exchanged for cash.
6. Can I use the Gift Card with a promotional code?
Yes, in most cases. The Gift Card acts as a form of payment, so you can typically apply a valid coupon code or promotion alongside using your Gift Card balance.
7. What happens if I return an item I bought with a Gift Card?
If you return an item that was purchased using a Gift Card, the value of the refund for that item will be credited back to the original Gift Card code.
